Acceptable Use Policy
This Acceptable Use Policy ("AUP") governs your use of the Kraken AI platform (also referred to as "Kraken" or the "Kraken Platform"), APIs, and related services (the "Services") provided by Optima Engineering LLC ("Optima"). This AUP is incorporated into and supplements our Terms of Service. Violations of this policy may result in suspension or termination of your access to the Services.
You are responsible for ensuring that your use of the Services, including all activity by your authorized users and any AI agents operating under your account, complies with this policy.
1. Universal Prohibited Uses
You may not use the Services, directly or indirectly, to engage in or facilitate any of the following:
Illegal and Harmful Activities
- Any activity that violates applicable federal, state, local, or international laws or regulations.
- Child sexual abuse material (CSAM), including AI-generated content depicting minors in sexual situations.
- Terrorism, violent extremism, or content that incites violence against individuals or groups.
- Human trafficking, forced labor, or exploitation of any person.
- Harassment, bullying, threats, or intimidation of individuals or groups.
- Non-consensual intimate imagery, including AI-generated synthetic media (deepfakes) of real individuals.
Weapons and Dangerous Materials
- Development, procurement, or deployment of chemical, biological, radiological, or nuclear (CBRN) weapons.
- Creation of actionable instructions for building weapons or explosive devices.
- Use of agents to autonomously control or operate weapons systems.
Fraud and Deception
- Phishing, social engineering, impersonation, or identity fraud.
- Generating false or misleading content for disinformation campaigns or influence operations.
- Misrepresenting AI-generated content as human-created.
- Creating deceptive content to manipulate financial markets.
- Generating fake reviews, testimonials, or endorsements.
Privacy and Surveillance
- Tracking, monitoring, or profiling individuals without their knowledge and consent.
- Mass surveillance or bulk collection of personal data.
- Building facial recognition, biometric identification, or emotional recognition systems without explicit consent and legal basis.
- Aggregating personal data to build profiles based on protected characteristics (race, ethnicity, religion, sexual orientation, disability, etc.).
- Unauthorized access to or collection of personal information from third-party services.
Security and System Integrity
- Distributing malware, viruses, ransomware, or other malicious code.
- Unauthorized access to computer systems, networks, or data.
- Scanning, probing, or testing the vulnerability of any system without authorization.
- Launching denial-of-service attacks or intentionally degrading service performance.
- Intercepting, monitoring, or altering network communications without authorization.
Intellectual Property
- Infringing copyrights, trademarks, patents, trade secrets, or other intellectual property rights.
- Using the Services to generate content that systematically reproduces copyrighted material.
- Using agent outputs to train competing AI models without authorization.
Elections and Democratic Processes
- Voter suppression, manipulation, or intimidation.
- Generating false information about candidates, voting procedures, or election security.
- Automated political lobbying using fabricated information or synthetic personas.
2. AI Agent-Specific Requirements
Kraken AI is an AI Agent Harness Platform. The following requirements apply specifically to AI agents deployed and operating on the platform:
Autonomous Operation Controls
- Human oversight: you must implement appropriate human-in-the-loop controls for agents performing consequential actions, including financial transactions, data modifications, communications sent on behalf of individuals, and interactions with critical systems.
- Least-privilege access: agents must be configured with the minimum permissions necessary for their intended function. Do not grant agents broad or unrestricted access to systems, data, or credentials.
- Kill-switch readiness: you must configure and maintain the ability to immediately halt agent operations when necessary.
Agent Safety and Integrity
- Do not attempt to bypass, circumvent, or disable platform safety controls, guardrails, or behavioral boundaries.
- Do not craft inputs designed to manipulate agent behavior through prompt injection or similar techniques.
- Do not decompose prohibited activities into seemingly innocuous sub-tasks to circumvent safety measures.
- Do not configure agents to self-replicate, spawn uncontrolled copies, or recursively escalate their own permissions.
- Do not use multiple agents in coordination to perform activities that would be prohibited for a single agent.
Agent Data Handling
- Do not use agents to harvest credentials, API keys, passwords, or authentication tokens they encounter during operations.
- Do not use agents for mass data scraping or systematic extraction of data from websites or third-party services.
- Do not use agents to exfiltrate data to unauthorized destinations.
- Do not use agents to conduct surveillance across multiple platforms or services.
AI Transparency
- When agents interact with end users or external parties, you must clearly disclose that they are interacting with an AI system.
- Do not misrepresent agent capabilities, limitations, or the nature of agent-generated content.
- Do not represent agent outputs as human-generated when they are not.
3. High-Risk Use Case Requirements
If you use the Services in the following domains, additional safeguards are required:
Domains Requiring Additional Safeguards
- Legal advice, judicial processes, or law enforcement applications.
- Medical, health, or clinical decision-making.
- Financial advice, credit decisions, insurance underwriting, or fraud detection affecting individuals.
- Employment decisions, including hiring, performance evaluation, and termination.
- Housing, lending, or public benefits eligibility determinations.
- Critical infrastructure operations (energy, transportation, water, telecommunications).
- Education admissions, grading, or disciplinary decisions.
Required Safeguards
For high-risk use cases, you must:
- Implement meaningful human review and approval before agent decisions are finalized or acted upon.
- Involve licensed professionals where applicable (e.g., licensed attorneys, physicians, or financial advisors).
- Maintain comprehensive audit trails of agent decisions and human reviews.
- Disclose to affected individuals that AI systems are involved in the decision-making process.
- Conduct regular assessments of agent performance, accuracy, and potential bias in these domains.
4. Platform Integrity
- Do not create multiple accounts to circumvent usage limits, access restrictions, or enforcement actions.
- Do not share, resell, or sublicense your platform access or API credentials to unauthorized parties.
- Do not impose unreasonable or disproportionate load on platform infrastructure.
- Do not interfere with or disrupt the Services or the experience of other customers.
- Do not use automated means to create accounts or circumvent rate limits.
- Do not access the Services for the purpose of competitive analysis, benchmarking, or building a competing product.
5. Export Controls and Sanctions
You may not use the Services in violation of applicable export control laws or economic sanctions, including those administered by the U.S. Department of the Treasury's Office of Foreign Assets Control (OFAC), the U.S. Department of Commerce, the European Union, or the United Kingdom. You represent that you are not located in, organized under the laws of, or a resident of any country or territory subject to comprehensive U.S. sanctions, and that you are not designated on any applicable restricted party list.
6. Reporting and Enforcement
Reporting Violations
If you become aware of any use of the Services that violates this AUP, please report it to report@optima.engineering. We reserve the right to investigate reports and take action in our sole discretion.
Enforcement Actions
If we determine that you have violated this AUP, we may take any action we deem appropriate in our sole discretion, which may include:
- Issue a warning and request remediation.
- Throttle or restrict access to specific features.
- Suspend your account pending investigation.
- Terminate your account and access to the Services.
- Report the activity to law enforcement at our discretion or as required by law.
We may act immediately with or without prior notice. We are not required to provide notice of enforcement actions.
7. Changes to This Policy
We may update this AUP at any time in our sole discretion. Updated versions will be posted on our website. All modifications are immediately binding upon posting. We are not obligated to notify you of changes. It is solely your responsibility to review this policy regularly. Your continued use of the Services constitutes your acceptance of the then-current policy.
